KLINICAPP RESPECTS THE PRIVACY OF EACH CUSTOMER

We, at KlinicApp, are careful in protecting our customer's personal information. To ensure transparency in our data protection, our privacy policy explains the process of data collection, usage and disclosure. All personal information collected will be used only as described in this privacy policy.

All the terms and phrases used in the Agreement will be per definitions established in this privacy policy, unless the context clearly indicates otherwise. E.g. "Data" describes any information (including Personal Information) provided to KlinicApp by a customer and service provider (Pathology Lab); and "Personal Information" refers to information about an identifiable customer, such as name, email address etc.

DATA COLLECTION

1. Customer Registration

During registration, each customer provides specific data including a log in ID, a password, and an email address. These details will be stored in our database to identify the customer during their next visit. For online payments, a customer may also provide necessary personal and billing information.

To combat online fraud, KlinicApp may also record the IP address of a customer while recording data. We automatically receive and record information on server logs from a customer's browser, including an IP address, KlinicApp cookie information, and the page requested. Each customer should be aware that other web sites visited before or after entering our page may record their personal information as well and we have no control over such web sites.

DATA USAGE

1. Call, Messages and Updates

We may call, send informative messages and email updates to a customer on their contact number/email accounts for our services. This may happen multiple times to facilitate the delivery of service and even after the service is delivered. We may also send promotional messages for new or existing services to our customers. Customers can choose to opt out of promotional messages by letting us know.

2. Cookies

We can use a customer's personal information to improve the user experience on our web site. We may use cookies to save the IDs and session validators on a customer's browsers and hard drives to provide a tailored web site. Recording IP addresses will help us diagnose problems and manage the web site.

3. Targeted Content

KlinicApp may display targeted adverts and other relevant information based on the customer's data while they are logged in. However, we never share any personal information with any advertiser, unless specifically asked by a customer in the consent pop up box on the advert. Advertisers receive a record of the total number of impressions and clicks for each advert. When a customer clicks on an advert, we only send a referring URL to the advertiser's site identifying that a customer is visiting from the web site. Once a customer is on the advertiser's site however, the advertiser may collect personal information based on their terms and conditions.

DATA DISCLOSURE

1. No Selling

KlinicApp does not sell, share, or distribute customer's personal information. All personal information disclosure will be only based on as agreed in this privacy policy.

2. Marketing Purposes

KlinicApp may disclose average statistics (information about the customer population in general terms) about the data to advertisers or business partners for marketing purposes.

KlinicApp is not responsible for, nor gives any warranties for the privacy and security practices of third party or any other linked web sites.

3. Third Party Supplier/ Agents/ Affiliates

KlinicApp may provide customer's data to a third party supplier/ agent/ affiliate to secure specific services to a customer (such as hosting, support services, shipping, or payment processing). The data disclosed will only be to the extent to enable the supplier to provide the specific services requested.

We can also disclose data to designated third parties to resolve or investigate abuse complaints. Data can be released to assist in attempting to block an abusive customer or complain to their Internet Service Provider.

KlinicApp is not responsible for, nor gives any warranties for the privacy and security practices of third party or any other linked web sites.

4. Law Enforcement

KlinicApp may disclose data if required by the law (e.g. by a subpoena or any other judicial or administrative order) to protect the safety of any individual or the general public, to prevent violation of the agreement as well as the rights of KlinicApp or any third party.

5. Change of Ownership

In case of a change of ownership (merger/ acquisition/ sale etc.), KlinicApp may reallocate the rights to data to the new owner. KlinicApp will send a prior notification to each Customer of the changes and the customer may choose to modify/ delete their personal data as they see fit.

6. Employees

KlinicApp will disclose data to its employees as and when they require to do their jobs.

SECURITY OF DATA

KlinicApp applies advanced security measures to protect the customer data repository. No data is released or shared without the customer's consent. The website uses a secure server environment with a robust firewall and other advanced security measures to prevent interference or access from intruders.

In addition, it is the responsibility of the customer to maintain the confidentiality of their log in details to prevent any unauthorised access to their data.

1. Updating or Removing Data

A customer can update the data submitted to KlinicApp by logging into their account and updating information, including deactivating their accounts if needed from the live database. However, data may still be stored on the backup files and archives.

2. Unauthorised Use

Any unauthorised use of KlinicApp information system is a violation of the agreement and certain laws, including the section 86 of the ECT Act. Such violations will be subject to civil and criminal penalties. In addition, to avoid any unauthorised use, we can intercept, block, filter, delete, and disclose any communication over our information system.

SERVICE DELIVERY & PAYMENTS

KlinicApp has a set of terms and conditions governing service delivery and payment processing which will be followed for all services and deliveries. Any conflicting case will be promptly denied unless we make a situational agreement with a customer under special circumstances. All customers will agree to our terms and conditions before making a service request.

1. Prices/Terms and Conditions of Payment:

o The service package charges specified on the website does not include the transaction or any additional charges the bank or payment portal applies and the customer shall pay the full price including these applied charges. In case of payment defaults (payment deadlines not met, online transaction denied, any other payment default), KlinicApp will automatically cancel the service request, with a notification sent to the customer.

o In the case of custom-made packages, we reserve the right to increase the price by a reasonable amount and to deviate to a reasonable extent from the agreed quantity.

2. Delivery Dates:

KlinicApp will strive to adhere to the stipulated delivery time by the service provider. However, these dates may not be binding, unless agreed otherwise, as the service provider may get delayed due to the hazards and peculiar features of lab testing. Our contractual obligations are subject to the concerned labs delivering the correct report to us on time.

3. Passing of Risk:

The lab providing the services will bear all risk of accidental loss, destruction or deterioration.

4. Errors in Report:

o Any errors in the report, in-spite of great care taken, should be reported immediately on our website or helpline numbers with the service ID, no later than 7 days after receipt of the report, and hidden errors must be notified without delay after their discovery, otherwise the reports shall be deemed accepted and no compensatory follow ups or services will be provided.

o For loss or damage caused by delay due to ordinary negligence, we shall be liable for up to only 5% of the booking price agreed with us.

5. Applicable Laws and Judicial Forum:

o Substantive laws of Republic of India shall apply to all legal relationships and transactions established by this purchase agreement.

o The judicial forum for both parties, including for bill of contract matters, is our principal place of business (registered office). If we become the plaintiff in litigation, then we are also entitled to bring an action in the jurisdiction of the customer's principal place of business (registered office).

REFUND & CANCELLATION POLICY

1. KlinicApp provides all rights to a client to cancel the order any time before the services start with a full refund initiated. A service is deemed to start as soon as the sample collector leaves for sample collection to the respective client chosen address. A service request will not be deemed cancelled once the service has started.

2. In case of delay in services from the service provider, customer can ask for full refund.

3. In case a client is not happy with our services (before sending the sample to the lab), they can inform the same by calling or sending an email to our customer support address provided at our website with "order ID" mentioned in the subject line. In such cases, sample will not be processed and full refund will be initiated.

4. In case of any issue with the reports, client can inform the same within 1 day of reports publication. In such cases we can ask the respective service provider to repeat the test on the sample collected from the client.

5. Any issues raised after 48 hours of reports publication will not be entertained since the samples collected will not be viable and would require fresh sample collection. This would be treated as new order and would be chargeable at normal rates.

Refunds would be processed within 7-10 business days of a cancellation.


General terms and conditions for coupons

KlinicApp issues coupons and discounts to its users to reward them for their relationship with KlinicApp. Below are the terms and conditions of using the coupons. KlinicApp reserves the right to change/update these terms and conditions anytime. To make the best use of the coupons, please go through the following terms and conditions applicable on all coupon codes

1. To avail benefits of coupons it has to be applied at the time of checkout. Not applying relevant coupons will not entitle the order for discount.

2. Coupon Codes comes with validity and have to be used within the same time frame. Unused coupons will be expired after their validity ends.

3. Coupons are single use only and are user bound unless otherwise specified. You can not transfer your unused coupons to any other user.

4. Multiple coupons can not be clubbed together. Only one coupon can be redeemed at a time.

5. Hard copy charges and sample collection charges if applicable will be applied on the net amount payable upon application of the coupon code unless otherwise mentioned.

7.These are app only coupons and can be redeemed on KlinicApp's mobile app only and not through any other channel.

8. KlinicApp reserves the right to change the terms and conditions of any coupon code any time without prior intimation.

9. Coupons are user specific and are non-transferable.


First order coupons terms and conditions

KlinicApp issues booking coupons on first order of each user. Users can use these coupons to save on their future orders on KlinicApp. Below are the terms and conditions for these coupons:

1. Only the first order on KlinicApp is entitled for first order coupons per user.

2. Currently users get coupons equivalent to their first order value.

3. Coupon equivalent to the first order value will be issued in the form of codes of various denominations cumulatively amounting to the order value. Currently the denominations are Rs.150, Rs.100 and Rs.50. The order value will be divided in these denomination from highest to lowest and remainder amount will be rounded off to nearest denomination. For e.g. if the order value is Rs.1078 then the customer will get 7 coupons of Rs.150 each and one coupon of Rs.50 taking to total to Rs.1100.

4. Coupons will be credited to your KlinicApp account once your reports for the tests in the first order are uploaded. In case of partial sample collection coupons will be issued for only the amount for which sample was collected, remainder coupons will be issued as and when the sample collection happens. For partly cancelled orders only the proportionate worth of coupons will be issued and not the whole order value.

5. To redeem these coupons minimum cart value should be Rs.500.

6. All the general coupons terms and conditions mentioned above are applicable on first order coupons.

7. This offer is also applicable to users who have placed orders with KlinicApp in the past but have not received the first order coupons. These user will receive first order coupon on their next order with KlinicApp.

8. These are app only coupons and can be redeemed on KlinicApp's mobile app only and not through any other channel.

9. These coupons are non transferable and comes with validity after which unused coupons will be expired.

10. KlinicApp reserves the right to change or withdraw this offer at their own discretion without any prior intimation.

11. Coupons are user specific and are non-transferable.


Signup coupons terms and condition

KlinicApp is currently issuing signup coupons to every new user who downloads the app and signup. Users can use these coupons to save on their future orders on KlinicApp. Below are the terms and conditions for these coupons:

1. Signup coupons will be issued only once per user irrespective of the number of time user downloads the app through single or multiple app stores.

2. Not applicable on signup through web or for orders placed through phone channel.

3. Currently users will get signup coupons worth Rs.500 however this may change at KlinicApp discretion with prior intimation.

4. Coupon will be issued in the form of codes of various denominations cumulatively amounting to Rs.500.

5. To redeem these coupons minimum cart value should be Rs.500.

6. All the general coupons terms and conditions mentioned above are applicable on first order coupons.

7. KlinicApp reserves the rights to change these conditions or withdraw the offer without any prior intimation.

8. Coupons are user specific and are non-transferable.
